Welcome to Macani (the “Service”), a product of Search7 Pty Ltd (ABN 98 132 143 125) (“Search7,” “Company,” “we,” “us,” or “our”), an Australian proprietary company with its registered office in Queensland, Australia.
This document contains two parts: Part One sets out the Terms of Service governing your use of the Service, and Part Two sets out our Privacy Policy describing how we collect, use, and protect your personal information.
By creating an account, accessing, or using the Service, you agree to be bound by both parts of this document (together, the “Terms”). If you do not agree, please do not use the Service.
By accessing or using the Service, you affirm that you are at least 18 years old (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
Macani is a free-to-use application that helps people coordinate and stay connected in person. Macani’s main features include:
Macani is provided to users free of charge, with no subscription required. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
To use certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at info@macani.io of any unauthorized use.

We may suspend or terminate accounts that violate this section.
You retain ownership of any content you submit, post, or upload to the Service (“User Content”).
By submitting User Content, you grant Search7 a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content solely for the purpose of operating and improving the Service.
You are solely responsible for your User Content and represent that you have all necessary rights to submit it.
The Service, including its design, software, text, graphics, and the “Macani” name and logo, is owned by Search7 or its licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.
The Service may contain links to or integrations with third-party websites or services. We do not control and are not responsible for the content, policies, or practices of any third party.
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including Sections 6, 9, 10, 11, and 12) will survive.
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, or that the Service will be uninterrupted or error-free.
Consumer guarantees. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where our liability for breach of a non-excludable guarantee can be limited, it is limited, at Search7’s option, to resupplying the Service or paying the cost of having the Service resupplied.
Subject to Section 9, and to the maximum extent permitted by law, Search7 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Except to the extent such a limitation is prohibited by the Australian Consumer Law or other applicable law, Search7’s total liability for any claim arising out of these Terms will not exceed the total amount, if any, that you have paid to Search7 for use of the Service in the twelve (12) months preceding the claim — noting that Macani is currently provided free of charge.
You agree to indemnify and hold harmless Search7 and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal costs) arising from your use of the Service or violation of these Terms.
These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
Optional: consider adding an arbitration clause or exclusive-jurisdiction wording here — recommend having counsel confirm which approach suits Macani’s user base, especially if you have overseas users.
We may update these Terms from time to time. We will post the revised version with an updated “Last Updated” date and, where required by law, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
This Privacy Policy explains how Search7 collects, uses, discloses, and safeguards personal information when you use Macani, and has been drafted with reference to the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
Note: the Privacy Act’s obligations generally bind businesses with annual turnover over AUD $3 million, or that meet certain other criteria (e.g., trading in personal information, providing a health service). If Search7 qualifies as a “small business operator” and no exception applies, some obligations below may not be strictly mandatory — but following them is still recommended, and becomes necessary if Macani has users in the EU/UK, California, or other regulated regions. Confirm applicability with your lawyer.
Location information is central to how Macani works, so we want to be clear about how it’s collected, used, and shared.
With your permission, we collect precise (GPS-based) location information from your device, including:
We only collect precise location information while you have granted location permission through your device settings. You can review or revoke this permission at any time; doing so will limit or disable location-based features.
We use location information to power Macani’s core features: showing meeting participants’ locations and arrival times (Geo Meeting), sharing real-time location with people you choose (Geo Tracking), and triggering entry/exit alerts for boundaries you define (Geo Fencing).
Your location is shared only with the other users you explicitly choose to share it with — for example, participants in a specific Geo Meeting, or contacts you’ve added for Geo Tracking. We do not sell your location information to any third party. We do not make your location visible to other Macani users unless you have chosen to share it with them.
You can stop sharing your location, end an active Geo Tracking session, or delete a Geo Fence at any time through the app.You have full control over your location sharing.
Real-time location is discarded once a session ends. Data related to Geo Fencing is retained until deleted by the user.
We use personal information to:
Where we send direct marketing communications, we will do so in accordance with the Spam Act 2003 (Cth), including honoring unsubscribe requests. See Section 17 for how we use location information specifically.
We use cookies and similar technologies (e.g., pixels, local storage) to operate the Service, remember preferences, and analyze usage. You can control cookies through your browser or device settings; disabling them may affect functionality.
We may share personal information with:
We do not sell your personal information — including your location information — to any third party. See Section 17 for how your location is shared with other Macani users.
We retain personal information for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements, after which it is deleted or de-identified.
We implement reasonable technical and organizational measures designed to protect personal information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
You may request access to the personal information we hold about you and request correction of inaccurate information, in line with APPs 12 and 13. To make a request, contact us at info@macani.io. If you’re not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
Where we disclose personal information to an overseas recipient, we take reasonable steps consistent with APP 8 to ensure the recipient does not breach the Australian Privacy Principles, except where an exception applies.
The two sections below are EU/US-specific — keep them only if Macani has users based in the EEA/UK or California; otherwise delete.
If you are located in the EEA or UK, our legal bases for processing include performance of a contract, legitimate interests, consent, and legal obligation. You have the right to lodge a complaint with your local data protection authority.
California residents have the right to know what personal information is collected, request deletion, correct inaccurate information, opt out of the “sale” or “sharing” of personal information (if applicable), and receive non-discriminatory treatment for exercising these rights.
The Service is not directed to children. Consistent with OAIC guidance, we treat individuals under 15 years of age as unable to independently consent to our collection of their personal information without the involvement of a parent or guardian. If we become aware we have collected personal information from a child without appropriate consent, we will delete it.
Your information may be transferred to and processed in countries other than Australia, which may have different data protection laws. Where required, we take reasonable steps (consistent with APP 8) or implement other appropriate safeguards for such transfers.
We may update this Privacy Policy periodically. We will post the revised version with an updated “Last Updated” date and, where required, notify you of material changes.
